Welcome to Viva. By downloading, accessing, or using the Viva mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
By creating an account or using Viva, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Viva ("we," "our," or "us").
You must be at least 13 years old to use Viva. By using the App, you represent that you meet this requirement. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to keep it up to date. You may not share your account with others or create multiple accounts to gain a competitive advantage.

We reserve the right to investigate suspected violations and take appropriate action, including account suspension or termination.
Viva integrates with Apple HealthKit, Google Fit, and connected wearables to power competitive features. You retain ownership of your fitness data. By connecting these services, you grant Viva permission to read and display your fitness metrics within the App solely for the purpose of operating matchups, leagues, and leaderboards. We do not sell your fitness data.
All content, features, and functionality of the Viva App — including but not limited to the name, logo, design, code, and scoring systems — are the exclusive property of Viva and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
You retain ownership of any content you submit to the App (such as profile photos or usernames). By submitting content, you grant Viva a non-exclusive, royalty-free license to use, display, and distribute that content within the App.
By you: You may delete your account at any time from the Settings screen within the App. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Some data may be retained for legal purposes or in anonymized form.
By us: We reserve the right to suspend or permanently terminate your account at our discretion if we determine you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a manner harmful to other users or the integrity of the platform. We will make reasonable efforts to notify you when doing so, except where prohibited by law or where immediate action is necessary.
Viva is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the App is at your own risk.
To the fullest extent permitted by law, Viva and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve months preceding the claim (which, for a free app, is zero dollars).
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of New York County, New York.
We may update these Terms from time to time. If we make material changes, we'll notify you via the app or email. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
